Former federal prosecutor

Chief of the Criminal Division at the USAO-SDFL during the Epstein NPA negotiations. Announced Acosta's plea decision to the FBI team on July 26, 2007. Had private conversations about the case with defense attorney Lilly Ann Sanchez, his former colleague. Left USAO on August 3, 2007 — days after announcing the plea — to join Kobre & Kim. Subsequently socialized extensively with Epstein from 2010 through at least December 2012, including dinners and multi-day visits in New York. Victims' attorneys suspected an improper relationship.

Key Findings

  • EFTA00225378 (Jul 3, 2007): Using Sloman's BlackBerry, sent unauthorized plea offer to defense attorney Lilly Ann Sanchez: 'I told Lily that a state plea with jail time and sex offender status may satisfy the usa' — without consulting Villafana, the FBI, or the victims
  • EFTA00225378 (Jul 5, 2007): Reprimanded Villafana for objecting to unauthorized plea negotiations: 'as Chief of the Criminal Division, I am the person designated by the US Attorney to exercise appropriate discretion in deciding whether certain pleas are appropriate and consistent with the Ashcroft memo and the USAM — not you'
  • EFTA00225378 (Jul 26, 2007): As Criminal Division Chief, announced to FBI agents and Villafana that 'Alex [Acosta had] decided to offer a two-year plea to Mr. Epstein'
  • EFTA00225378, EFTA00223698 (Nov 2006): Had private conversations with defense attorney Lilly Ann Sanchez regarding resolution of the Epstein matter. Sanchez was Menchel's former colleague — she had been Deputy Chief of Major Crimes while Menchel was Chief of Major Crimes at the same USAO
  • EFTA00225378 (Aug 3, 2007): Left USAO on August 3, 2007 to become partner at Kobre & Kim in New York — days after announcing Acosta's plea decision and while NPA negotiations were still underway
  • EFTA00027873 (Oct 24, 2010): Email from Menchel to Epstein: 'Jeffrey, I very much enjoyed our talk the other night. I look forward to the possibility of working together.' Epstein had written: 'now that there can be no conflict. when are you next in new york'
  • EFTA01740430 (Oct-Nov 2011): Multiple emails arranging meetings in New York. Menchel offered to visit during 3-week NY stay. Groff (Epstein's assistant) coordinated scheduling
  • EFTA00936095, EFTA02168099 (Jun 1, 2012): Epstein's schedule shows '7:30 Dinner w/Matt Menchel' — same day as appointment with Leon Black and reminder to see Ken Starr. Groff email: 'Matt Menchel Dinner is ON!'
  • EFTA02153586, EFTA02028126 (Dec 2012): Schedule notes 'Matt Menchel to depart today, Dec. 10' and 'People to See' list includes 'Matt Menchel (in NY Dec. 6-10)' — multi-day visit
  • EFTA01099834: Victims' attorneys wrote that 'Menchel's apartment, his role during the Epstein negotiations and his departure immediately after the NPA was signed, leads us to believe that [Menchel] and Epstein may have had a business or other relationship either during or after [Menchel's] time in the Office'
