ORDER DENYING MOTION TO RESET TRIAL DATES AND PRETRIAL DEADLINES FOR CASES 08-80811 AND 08-80893 THIS CAUSE came before the Court upon Defendant Epstein's Motion to Strike Cases from Current Trial Docket and Motion to Continue Case and/or Alternative Motion to Modify 3 EFTA02745079 Case 9:08-cv-80119-KAM Document 187 Entered on FLSD Docket 07/06/2009 Page 4 of 4 Trial and Scheduling Order Deadlines for C.M.A, Jane Doe (80893), and Jane Does 2-7, filed May 19, 2009. (DE 104). The Court has reviewed the motion, responses, and replies, and is otherwise fully advised in the premises. It is hereby ORDERED AND ADJUDGED that Epstein's Motion to Continue (DE 104) is DENIED as to Plaintiffs C.M.A and Jane Doe (80893). After reviewing the parties' submissions and the record, the Court finds that Defendant's motion to continue is premature. These cases were filed nearly a year ago and there are still several months before the respective December 2009 and February 2010 trial dates. If discovery disputes have precluded the ability of counsel to prepare for trial, the Court will consider a short extension to the discovery deadlines, but under the present circumstances, the trial dates will not be delayed. Counsel should conduct themselves accordingly. DONE AND ORDERED in at West Palm Beach, Palm Beach County, Florida, this 51° day of July, 2009. KENNETH A.
